Privacy Policy

1. Introduction

The Seibert Law Firm PC (“the Firm,” “we,” “us,” or “our”) is committed to protecting the privacy and confidentiality of our clients and website visitors. This Privacy Policy explains how we collect, use, and safeguard information collected through our website at mytexaslawyer.com (the “Site”) and in the course of providing legal services, in accordance with applicable laws, including the Texas Data Privacy and Security Act (TDPSA) where applicable.

2. Information We Collect

We may collect the following categories of information:

  • Personal Information you provide directly, such as your name, mailing address, telephone number, and email address.
  • Client and Matter Information, including details about your legal matter that you share when contacting us, completing a web form, requesting a consultation, or becoming a client.
  • Technical Data collected automatically when you visit the Site, such as IP address, browser type, device information, referring URL, pages viewed, and time stamps. This information is collected through cookies, log files, and similar technologies.
  • Communications submitted through contact forms, email, text, or consultations.
  • Information from Third Parties, such as opposing counsel, courts, expert witnesses, service providers, or public records, when relevant to a legal matter we are handling.

3. How We Use Your Information

We use the information we collect to:

  • Respond to inquiries and evaluate potential representation;
  • Provide legal services and communicate with clients and prospective clients about their matters;
  • Maintain client records and comply with our professional and ethical obligations;
  • Maintain, improve, and secure the Site;
  • Detect, prevent, and address technical or security issues; and
  • Comply with applicable laws, court orders, and regulatory requirements.

4. No Attorney-Client Relationship Through the Site

Submitting information through this Site, sending us an email, or requesting a consultation does not create an attorney-client relationship. An attorney-client relationship is formed only after we have performed a conflicts check, agreed in writing to represent you, and you have signed a written engagement agreement with the Firm. Please do not send confidential or sensitive information through unsecured channels until a formal attorney-client relationship has been established.

5. Confidentiality and Attorney-Client Privilege

Information you share with us after becoming a client is protected by the attorney-client privilege, the work-product doctrine, and the Texas Disciplinary Rules of Professional Conduct. We do not disclose client confidences except as authorized by the client, required by law, or permitted by the applicable rules of professional conduct.

6. How We Share Information

We do not sell or rent your personal information. We may share information in the following limited circumstances:

  • With your consent, or at your direction, in the course of representing you;
  • With service providers who support the Firm’s operations (such as IT, hosting, document management, billing, and e-discovery vendors), subject to appropriate confidentiality obligations;
  • With courts, opposing parties, or third parties when necessary to advance your legal matter;
  • When required by law, subpoena, court order, or legal process; and
  • To protect our rights and safety, including to prevent fraud, enforce our agreements, or comply with our ethical obligations.

7. Cookies and Analytics

The Site may use cookies and similar technologies to improve functionality and analyze visitor behavior. You may disable cookies through your browser settings, but doing so may affect your experience on the Site. We may use analytics providers (such as Google Analytics) that collect aggregated, non-identifying information about Site usage.

8. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect the information in our possession from unauthorized access, disclosure, alteration, or destruction. No method of transmission over the internet or electronic storage, however, is completely secure, and we cannot guarantee absolute security.

The Site may contain links to third-party websites. We are not responsible for the privacy practices or content of those sites. We encourage you to review the privacy policies of any site you visit.

10. Children’s Privacy

The Site is not directed to children under the age of 13, and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to remove it.

11. Your Privacy Rights (Texas Residents)

Where applicable, Texas residents may have rights under the Texas Data Privacy and Security Act, including:

  • The right to access personal data we hold about you;
  • The right to correct inaccuracies in that data;
  • The right to request deletion of personal data;
  • The right to obtain a portable copy of your personal data; and
  • The right to opt out of certain data processing, including targeted advertising, the sale of personal data, and certain forms of profiling.

In addition, you may opt out of marketing communications at any time by following the unsubscribe instructions in any email we send or by contacting us directly.

To exercise any of these rights, contact us using the information in Section 14. We will respond within the timeframe required by law. Please note that certain records we are required to maintain under the Texas Rules of Disciplinary Procedure, the Texas Rules of Civil Procedure, or other applicable law cannot be deleted or altered upon request, and some requests may be denied or limited to the extent permitted by law.

12. Retention

We retain client files and related information for the period required by applicable law, the Texas Disciplinary Rules of Professional Conduct, and the Firm’s records retention policy. After that period, information is securely destroyed or de-identified.

13. Updates to This Policy

We may update this Privacy Policy from time to time. The “Effective Date” above reflects the most recent revision. Continued use of the Site after any changes constitutes acceptance of the revised Policy.

Document Retention Policy

The Seibert Law Firm, PC is a fully digital law firm and do not maintain paper files. All client documents and records are stored securely in electronic format. If we receive paper files they are scanned and returned or shredded.  

We retain these files for five (5) years after your matter concludes, after which they may be securely deleted. We encourage you to download or request copies of your documents for your own records during that time.
